{"id":11821,"date":"2021-12-28T20:02:54","date_gmt":"2021-12-28T18:02:54","guid":{"rendered":"https:\/\/emmi.lv\/?page_id=11821"},"modified":"2022-08-08T12:15:41","modified_gmt":"2022-08-08T09:15:41","slug":"atteikuma-tiesibas","status":"publish","type":"page","link":"https:\/\/emmi.lv\/en\/atteikuma-tiesibas\/","title":{"rendered":"Right of withdrawal"},"content":{"rendered":"<div data-elementor-type=\"wp-page\" data-elementor-id=\"11821\" class=\"elementor elementor-11821\" data-elementor-post-type=\"page\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-ca30668 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"ca30668\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-7471034\" data-id=\"7471034\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-561d050 elementor-widget elementor-widget-text-editor\" data-id=\"561d050\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>A natural person who wishes to purchase, purchases or could purchase or use a product or service for a purpose that is not related to economic or professional activity (hereinafter referred to as the consumer) in accordance with <a href=\"http:\/\/likumi.lv\/doc.php?id=266462\" target=\"_blank\" rel=\"noopener\">Clause 19 of Regulation No. 255 of the Cabinet of Ministers of the Republic of Latvia &quot;Regulations on distance contracts&quot; on distance contracts<\/a> can use the right of refusal and return the purchased product within 14 calendar days from the moment of purchase.<\/p><p>In order to use the aforementioned right of withdrawal, you must inform SIA EMMI 4 electronically by sending a submission or a withdrawal form (<a href=\"https:\/\/emmi.lv\/wp-content\/uploads\/2022\/08\/Atteikuma-veidlapa.docx\"><em><strong>the waiver form is available for download here<\/strong><\/em><\/a>) to the electronic mail address info@emmi.lv or in writing by sending a submission or refusal form to the address Spoles iela 3, Riga, LV-1058, Latvia.<\/p><p>Sending the refusal form or application within the specified period releases the consumer from any contractual obligations in connection with the respective distance contract. The consumer is obliged to return the product to the seller within seven days from sending the refusal form or application (sending an electronic letter or postmark). After returning the goods, the seller assesses the condition of the returned goods and prepares a document on the return of funds and sends it in the form of a reply electronically or to the specified address. If the consumer approves the content of the document on the return of funds, the seller is obliged to refund the amount of money paid for the product to the consumer within seven days after receiving the consumer&#039;s approval.<\/p><div>Our recommendations to avoid misunderstandings:<\/div><ul><li>at the time of receiving the goods, make sure that it fully corresponds to the ordered one - manufacturer, model, color, size and other important parameters. The right of refusal is not valid for a product that was delivered by courier and has a scratch or any other mechanical damage and this is not indicated immediately upon receipt of the product. If you see any visible damage to the package, please ask the courier to note it on the delivery form. This will help to quickly find a solution in case the product itself was also damaged during delivery! You have the right not to accept a product whose packaging is damaged or looks suspicious already at the time of delivery.<\/li><li>Check but don&#039;t use the item.<\/li><li>Do not open the audio, video, or computer software package.<\/li><li>Keep and do not damage the product&#039;s original packaging and assembly (sealed plastic packages may be carefully opened with scissors).<\/li><\/ul><p>If the consumer exercises the right of refusal and it is not related to the non-compliance of the relevant product or service with the terms of the contract, then the consumer is obliged to cover the costs associated with sending the product back.<\/p><p><strong>Procedure for consideration of other complaints<\/strong><\/p><p>Please submit a complaint about the availability or quality of goods electronically by sending it to the email address info@emmi.lv or in writing to the address Spoles iela 3, R\u012bga, LV-1058, Latvia. Within 7 working days from the date of receipt of the application, the seller provides the consumer with a written response to the application, sending the answer to the contact address specified in the complaint, and informs about the possible way of fulfilling the claim or resolving the dispute, if no agreement has been reached on the fulfillment of the consumer&#039;s claim or an alternative way of fulfilling the claim within the said period.<\/p><p>If the complaint is recognized as unfounded and you do not agree to the recognition of the complaint as unfounded, you have the right to use the alternative dispute resolution options provided for in the regulatory enactments by submitting a written application to the seller of the goods for out-of-court dispute resolution, stating:<\/p><div class=\"container\"><div class=\"static-block-1 justify\"><ul><li>name, surname, contact information;<\/li><li>date of submission of the application;<\/li><li>the nature of the dispute, the claims and their justification.<\/li><\/ul><p>Information on out-of-court dispute resolution options and out-of-court dispute resolvers:<\/p><ul><li><a href=\"http:\/\/www.ptac.gov.lv\/lv\/content\/stridu-risinasanas-process\" target=\"_blank\" rel=\"noopener\">http:\/\/www.ptac.gov.lv\/lv\/content\/stridu-risinasanas-process<\/a><\/li><li><a href=\"http:\/\/www.ptac.gov.lv\/lv\/content\/arpustiesas-pateretaju-stridu-risinataju-datubaze\" target=\"_blank\" rel=\"noopener\">http:\/\/www.ptac.gov.lv\/lv\/content\/arpustiesas-pateretaju-stridu-risinataju-datubaze<\/a><\/li><li><a href=\"https:\/\/ec.europa.eu\/consumers\/odr\/main\/index.cfm?event=main.home2.show&amp;lng=LV\" target=\"_blank\" rel=\"noopener\">SIT platform: https:\/\/ec.europa.eu\/consumers\/odr\/main\/index.cfm?event=main.home2.show&amp;lng=LV<\/a><\/li><\/ul><p>Within 15 working days from the date of receipt of the application, the seller provides the consumer with a written response to the application, sending the answer to the communication address specified in the complaint, and informs about the possible way of fulfilling the claim or resolving the dispute, if no agreement has been reached on the fulfillment of the consumer&#039;s claim or an alternative way of fulfilling the claim within the said period.<\/p><p><strong class=\"red\">Important<\/strong><\/p><p>SIA EMMI 4 does not keep the concluded purchase contracts.
